Terms of Use

Article 1: Purpose

These Terms of Use (the "Terms") set out the conditions under which GearGo Fitness makes the app and available services accessible to its users, and how the user accesses and uses them.

The GearGo Fitness app is published by GearGo Fitness. For any question, contact us at contact@geargo.fr.

The website geargo.fr is hosted by Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, USA.

Article 3: Access to the service

The GearGo Fitness app is accessible free of charge to any user with a compatible device and an Internet connection. Any costs incurred by the user to access it (hardware, Internet connection, etc.) are their own responsibility.

Article 4: Premium subscription

GearGo Fitness offers an optional Premium subscription, purchased via the App Store (iOS) or Google Play Store (Android), granting access to additional features (AI-generated training plans and other benefits described in the app). The subscription is offered on a monthly or yearly basis, at the price displayed in the app and on the app store listing at the time of purchase; this price may change over time without retroactive effect on subscriptions already purchased.

The subscription renews automatically: unless canceled by the user at least 24 hours before the end of the current period, it is automatically renewed for an identical duration, at the then-current price, and the amount is charged to the user's App Store or Google Play account within 24 hours before the end of the current period.

The user may cancel at any time, free of charge, from their App Store account settings (Settings > [name] > Subscriptions) or Google Play (Play Store > Menu > Subscriptions). Cancellation takes effect at the end of the period already paid for; no pro-rata refund is issued for the current period. Management of payment methods, refunds and billing disputes is handled exclusively by Apple or Google, in accordance with their respective terms.

Article 5: Intellectual property

The trademarks, logos, signs and all content of the app (text, images, data) are protected under the French Intellectual Property Code, and more specifically by copyright.

The user must obtain GearGo Fitness's prior authorization for any reproduction, publication or copying of its content. The user agrees to use the content strictly for private purposes. Any commercial use is strictly prohibited.

Article 6: Personal data

GearGo Fitness collects and processes personal information in a manner that respects the user's privacy, in accordance with French law n°78-17 of January 6, 1978 on data processing, data files and civil liberties, as well as the General Data Protection Regulation (GDPR). Details are available in our privacy policy.

The user has the right to access, rectify, delete and object to their personal data, which they may exercise by contacting us at contact@geargo.fr.

Article 7: Liability

The information published on the GearGo Fitness app, including AI machine recognition, suggested exercises and AI-generated training plans, is believed to be reliable, but GearGo Fitness does not guarantee it is free of errors, inaccuracies or omissions. This content is generated automatically by an AI system; the user must treat it as guidance and exercise their own judgment before following it. GearGo Fitness cannot be held liable for any injury or damage resulting from improper use of workout machines, failure to follow the safety instructions specific to each piece of equipment, or following AI-generated content unsuited to the user's physical condition.

Article 8: Hyperlinks

Hyperlinks may be present in the app or on the website. The user is informed that clicking these links will take them away from GearGo Fitness. GearGo Fitness has no control over the pages these links lead to and cannot be held responsible for their content.

Article 9: Governing law and jurisdiction

French law applies to these Terms. In the absence of an amicable resolution of any dispute between the parties, the French courts shall have exclusive jurisdiction.
